网络环境下著作权的合理使用与法定许可

网络造成公众与著作权人之间新的利益冲突,合理使用与法定许可成为网络环境下的利益平衡砝码。网络环境下,公众对著作权的合理使用范围应有所扩张,表现为公众对网上版权作品应有更大的合理复制权,但公众对版权作品在网上的合理传播权则应当相对缩小。通过对法定许可制度的批判,认为网络环境下应谨慎设置著作权法定许可制度。

The Rational Utilization and Legal Permission of the Copyright Under the Situation of Internet

Under the present situation of the internet,the utilization of the copyright by the public should be extend- ed in its scope,meaning that the public should have wider range of tights to duplicate the works in the intemet resources though the rights of the public to recast the works in the internet shall be restrained.
