非典危机引发的公民权利问题刍议

非典危机凸显政府预警和应急机制的局限,更反映出我国公民权利实现和保障上的问题。我们应以公民知情权和人身自由权为核心,借鉴国外维护和保障公民知情权的经验,在宪法和法律层面上规范和实现公民知情权,尽快制定《信息自由法》。同时,从个人自由和社会公众利益之间平衡的角度,分析抗击非典对公民人身自由的合理限制,强调坚持“法律下的自由”。

Discussion on SARS Crisis and Civil Rights

The SARS crisis has showed the limitation of government pre-warning mechanism and emergency measures. Furthermore, it has reflected the problem of realizing and ensuring civil rights in our country. We shoule take civil rights to know and personal freedom as the key issue, use overseas experience of maintaining and ensuring civil rights to know for reference,standardize and implement civil rights from the constitutional and legal aspect,and constitute"The Law of Information Freedom"as soon as possible. At the same time, from the point of view balancing individual freedom and public interests,we should put emphasis on adhering to "freedom under law".
