| 摘 要： | 证人出庭率低已是影响刑事诉讼质量的突出问题。证人不愿出庭作证,既有文化的原因,也有法制的原因。设立证人保护制度具有人权价值、秩序价值、证据保全价值和系统价值。应当借鉴外国经验,确立我国对证人保护的原则、范围、阶段和具体措施。

| Abstract: | The low percentage of witness' s appearing in court has become a striking problem that influences quality of criminal action.Witness's unwillingness to testify to give evidence in court has both cultural and legal reasons.To establish witness-protection system has the value of human rights,social order,evidence-protection and systematicness.We should use the experiences of other countries for reference,establish the principles,scales,stages and concrete measures for witness-protection. |
