行政行为附款新探

行政行为的附款包括条件、期限、负担、负担保留以及废止保留等类型。信赖保护在行政行为变更或消灭中是重要的考量因素,但信赖保护对于附款行政行为是否依然适用则依附款类型的不同情形而异。比例原则是判断附款是否违法不当的重要标准,其不仅在附款形式的选择方面,而且在附款的实质内容方面,都有其具体的运用。当附款违法时,相对人最有效的救济方式,应是提起课予义务之诉,请求法院依据附款违法类型采取不同的权利保护方式;而不是以附款与主行政行为是否可分为标准来决定是否采取单独撤销附款之诉的权利救济方式。
