对污染环境犯罪立法完善的思考

1997年 3月修订的《中华人民共和国刑法》在妨害社会管理秩序罪一章中增设了破坏环境资源保护罪一节 ,这无疑是我国刑法史上一件大事 ,开创了我国环境保护的新局面 ,加强了对犯罪的惩罚力度 ,标志着我国环境刑事立法正在逐步走向完善。但是 ,从刑法修订到目前 ,经过几年的司法实践 ,刑法中关于污染环境犯罪的规定日益凸现出其不足和缺陷。突出表现在罪的形态、犯罪结果以及法定刑上的缺陷。因此建议 :把污染环境犯罪所表现的罪的形态统一规定为危险犯 ;统一重大环境污染事故内容的标准 ;统一法定刑的标准 ;增加资格刑的处罚 ,以协调和加大对污染环境犯罪的打击力度 ,达到保护环境的目的。

The Reflection on the Criminal Law of Empoisoning Circumstance

In the chapter of CRIMES OF OBSTRUCTING THE ADMINISTRATION OF PUBLIC ORDER of CRIMINAL LAW OF THE PEOPLE'S REPUBLIC OF CHINA edited in Mar 1977, the section of the crime of sabotaging circumstance resource has been added. It is no mistake a great invent in the history of CRIMINAL LAW OF THE PEOPLE'S REPUBLIC OF CHINA, which initiates a new resource reserve phase, which strengthens the punishment of the crime of sabotaging resource, which implies we perfect resource criminal legislation step by step. At the same time, the deficiency of criminal law in the crime of empoisoning circumstance has been revealed gradually in practice, especially in the crime configuration, crime outcome, statutory punishment. So we suggest that the crime of empoisoning circumstance be prescribed critical crime, the criterion of empoisoning circumstance be unified, the criterion of statutory punishment be unified, the sanction of criminal be added. Only so can we prevent the criminal of empoisoning circumstance, furthest protect circumstance.
