和谐社会视野下公安机关刑侦强制措施与沉默权制度研究

刑侦强制措施作为公安机关侦破案件、发现证实犯罪的侦查手段是得到法律肯定的，然而现阶段公安机关在运用这种国家公权力进行案件调查时却侵害了公民的私权利——沉默权。本文从公安机关刑侦强制措施施行的现状及缘由，分析在我国现阶段设立沉默权制度的必要性及可能性，并提出构建我国刑事侦查中沉默权制度的设想。

On the public security organs' criminal investigations compulsory measures and the reticence right system in the harmonious society

The criminal investigations compulsory measure is accepted by law as an important investigation meas- ure,however,it has infringed person's reticence right when it is used by some public security organs.The paper an- alyzed the necessity and possibility of establishing the reticence right system from the view of the using criminal inves- tigations compulsory measures condition and offered some ideas about the reticence right system in criminal investiga- tions.
