死刑复核程序前后的“双向延伸”

死刑复核程序在慎用死刑方面起到重要作用。然而,在慎用死刑方面,除应对死刑复核程序进一步加以完善,使其更好地对死刑案件发挥把关作用外,更应当以死刑复核程序为基点,对于死刑案件进行“双向延伸”层层把关,即既要“向前延伸”,注重死刑复核程序之前的程序设计和依法适用,同时又要“向后延伸”,关注死刑复核程序之后的程序设计和权利赋予。

The "Bidirectional Extensions" of the Procedure for Review of Death Sentence in Forth and Back

The procedure for review of death sentence plays a significant role in the cautious case of death sentence.However,to ensure the cautious use of death sentence,we should further optimize the procedure for review of death sentence to make it act a better role in the final examination of the death penalty case;moreover,we should,on the basis of the current procedure for review of death sentence,take into account the "bidirectional extensions" of the death penalty case: we need not only the "forward extension" in that we should attach importance to the enactment of relevant procedures prior to the procedure for review of death sentence and their strict application in accordance with the law,but also the "backward extension" because we should lay emphasis on the stipulation of related procedures after the procedure for review of death sentence and relevant rights granted to the condemned criminal.
