| 摘 要： | 劳动合同是源于罗马法的雇佣契约社会化的结果,劳动关系虽受一定程度的国家干预,但仍属私权关系,劳动契约的有关规范仍属私法范畴,因此我国未来民法典合同篇中应规定雇佣契约章,作为劳动契约法制的基础,以解决学理与实务适用上的困难。

| Abstract: | Labor contract is the result of the socialization of employment contract in Roman Law. Law relationship in it is interfered by state power to some extent, but still belongs to private relationship. In this sense, the future civil code of the PRC shall provide employment contract chapter in contract section act as the basis of labor contract institution so as to solve the application difficulty in academic and practical respect. |
