宽容对待处置突发恶性事件时的警察行为——被允许的危险在刑法中的应用

Tolerantly treating the police' s behaviors in handling abrupt vicious affairs--The application of the allowed dangers to the criminal law

The allowed dangers are open in space and require judges and jurists to complement based on the unity principle of the legal order. The police's behaviors in dealing with abrupt vicious affairs should not be viewed as ordinance behaviors, nor are they equal to legitimate defense, but belong to allowed dangers. This article provides the judgment criteria for allowed dangers in dealing with abrupt vicious affairs, and studies the responsibility for the injury and killing of innocent crowds caused by the police in dealing with abrupt vicious affairs.
