| 摘 要： | 生育权是一项自然权利,是基本人权之一,但生育权的行使不同于其他民事权利。生育权的实现方式要受到社会的、伦理的等诸多因素的影响,因此生育权受到法律的规制实属必然,并应由夫妻双方共同行使。公民采用现代技术手段实现其生育权时,应得到法律的认可。

| Abstract: | Procreate right is a natural right and one of the basic human rights, but the exertion of procreate right differs from other civil rights. The implementation mode of procreate right is influenced by many factors, such as social and ethic elements. So procreate right is necessarily ruled by law, which should be exerted by both husband and wife. It should be recognized by law when citizens adopt modern techniques to realize their procreate rights. |
