未成年人社区矫正“分开进行”之研究

对未成年人的社区矫正应当与成年人分开进行。未成年人社区矫正"分开进行"源于未成年人特别、优先保护的需要,是国际准则与国内立法的具体要求,也是基于我国未成年人刑事司法实践的考量。美、英、日等国未成年人社区矫正模式对构建我国的未成年人社区矫正工作体系具有借鉴意义。我国未成年人社区矫正"分开进行"分为矫正前、矫正过程中和矫正后三个阶段。

The juvenile community correction mode in the United States, Britain, Japan and other countries has the reference significance for the construction of our country＇ s juvenile community correction system. The juven- ile community correction “separate operation” in our country is divided into three stages of correction beforehand, rectification process and correction afterwards.
