| 摘 要： | 交通肇事是司法实践中一种常见的违法犯罪现象,而交通肇事后逃逸致人死亡的认定更是司法实践的难点问题之一。本文拟通过对《刑法》第133条规定的诠释,进一步明晰交通肇事因逃逸致人死亡的罪过并试图从司法实践的层面解决种种因逃逸致人死亡情况下的定罪处罚。

| Abstract: | Traffic accident is a common criminal phenomenon in judicial practice,however,it's one of even harder problems to identify the fact of causing fatalities by Hit-and-Run.By the paper,on the understanding of No.133 article of The Criminal Law of P.R.China,the author further analyzes the guilt of causing fatalities by Hit-and-Run traffic accident,attempting to solve the penalty problems towards causing fatalities by Hit-and-Run traffic accident on the judicial practice levels. |
