中国法制“镂之金石”传统及特质

传统金石学研究多将金石视作整体。在当今的学术研究中,金石学的研究对象却分属于不同学科,以致考古学和古文字学多关注金文,历史学研究侧重于墓志,社会史学者偏向于碑刻。这种剖裂式研究使中国法制“镂之金石”的传承特色难以彰显。本文旨在以金石学的视角,对比金石法律文献研究之优长,考察“铭金”与“刻石”法律纪事的关联,进而揭示中国法制“镂之金石”传统的“礼制”和“公政”的特质,并以此展示中国古代法制文明的别样风景。

Chinese Legal System of the Ornamental Stone Traditions and Characteristics

The traditional study of epigraphy regards as one whole. But In today＇s academic research, the object of study about epigraphy belonging to different disciplines, so that archaeologists and ancient historians pay more attention to Jinwen, historians focused on the Gravestone Epitaph, social history scholars tend to stone inscription. This kind of split type research make the traditional Chinese legal system of the ornamental stone traditions is hard to reveal. The purpose of this paper is to conclude the status of legal literature study about inscriptions on ancient bronzes and stone tablets, investigate the correlation of Bronze and stone inscription, and then reveal the peculiarity of Chinese legal system used in the traditional ritual and political qualities, to show a new perspective of research the ancient Chinese legal system civilization.
