检察案例指导制度定位的反思与重整

检察案例指导的定位问题决定着整个检察案例指导研究的起点,当前检察案例指导的核心定位是司法管理手段,它仅反映了检察权行政性的一面,而没有回应检察机关司法性的要求,在实施中不可避免会带来相应的矛盾与冲突.这不但导致当前检察案例指导制度实施效果差强人意,与当前业已启动的司法去行政化改革方向亦有潜在的冲突.因而,应调整检察案例指导的制度定位,将其立足于“调控”而非“管理”更为适当。

On the Introspection and Reforming of the Definition of the Case Guidance System

The definition of case gudiance system decides the start of the whole case gudiance study. The core definition of the current case gudiance system is judicial management means, which only reflect the administrative part of procuratorial authority with no response to its judicial part. This can inescapablely bring corresponding contradictions and conflicts, which leads to the barely satisfactorty implementation effect of current case gudiance system. It also has potential conflicts with the started reform of jidicial administrization. Therefore, the definition of case gudiance system should be adjusted to ＂regualting function＂ rather than ＂control＂.
