| 摘 要： | 法律推理研究热潮的出现,说明我国法学研究已由注重对法律适用客体的本身研究转向法律适用主体的思维研究。但同西方国家相比,我国法律推理研究存在诸多明显不足。因此我国学者要吸纳和借鉴了国外法律推理研究的先进理论,形成了自己的概念、范畴和理论框架,以致服务于法制现代化,实现我国法治建设的目标。

| Abstract: | The upsurge in the studies on reasoning of law has indicated a shift in Chinese legal research from emphasizing legal applicable object per se to stressing legal applicable subject.However,compared to the West,the studies on reasoning of law in China still are obviously insufficient.In view of this,Chinese scholars are supposed to formulate their own concepts,scopes and theoretical framework by absorbing and drawing lessons from the advanced theories and findings of foreign studies on it,with an aim to serve the purpose of legal system modernization and China＇s legal construction. |
