| 摘 要： | 沉默权的确立在于对抗非法的侦查行为,因此。在侦查中赋予犯罪嫌疑人以沉默权,对于制止违法行为,重建民众对司法机关的信心具有非常重要的意义。在现阶段,实施沉默权要排除非法干扰,为侦查能力充分发挥创造良好的外部法律环境,并使沉默权的实施具有法律保障。
