| 摘 要： | 听证程序,是现代行政程序法中的一项核心制度,是行政法治标志之一。我国在1996年制定的《行政处罚法》确立了行政处罚听证程序。我国行政处罚法的听证程序存在的问题有:听证适用范围过窄;“较大数额罚款”规定的模糊性和适用混乱;听证笔录在行政处罚决定中的作用没有规定;没有规定听证排除性条件。
