| 摘 要： | 辩护制度是刑事诉讼制度的重要组成部分，关系到刑事诉讼所追求的程序正义价值目标能否达到。辩护律师在保障人权，实现司法公正的同时，也承忍了巨大的风险。而辩护律师豁免权则能够使辩护律师免受不当法律责任的困扰，并因此切实保障律师在刑事诉讼过程中尽职尽责。为了避免辩护律师滥用其豁免权，危害诉讼秩序和司法秩序，对辩护律师豁免权也应当进行合理限制。

| Abstract: | The defense system is an important part of the criminal procedure system, in relation to the aims of the value of procedural justice that the criminal procedure seek can achieve or not. Defense lawyers are also bearing great risk while in protection of human rights and realization of justice. The defense lawyer＇ s right of immunity can protect the defense lawyer from the perplex of improper legal liability, and therefore guarantee the fidelity of lawyers in criminal proceedings. But in order to avoid the defense lawyer from abusing their immunity, harming the order of the judicial and lawsuit, the defense lawyer＇ s fight of immunity should reasonably be limited. |
