论我国信托产业的经济法调整及其完善

现代信托业需要经济法的保障。信托业经济法制度的供给不足是目前制约我国信托业发展的瓶颈。其突出问题是 :信托业的主管机关与规范不统一、竞争关系未理顺、产业发展的限制过度、扶持政策缺失和国家参与经营过多等。完善我国信托业的经济法调整包括 :统一监管主体 ,整合市场规制法规 ;完善产权制度 ,探索信托业国家投资经营改革的具体办法 ;完善宏观调控制度 ,促进信托业快速健康发展。

On the Regulation and Perfection of China's Trust Industry by Economic Laws

Modern trust industry needs the protection of economic law.The insufficient supply of economic legal system for trust industry is the bottleneck that restricts the development of China's present trust industry.The major problems include: the disunity competent authorities and norms of trust industry, the disordered competitive relations, the excessive restriction on industry development, the loss of supporting policies as well as the excessive participation of the state in management. The regulation by economic law for perfecting China's trust industry includes: to uniform the subject of supervision, integrate market rules and regulations and systems;perfect the system of property right, explore the specific means of state investment management reform;perfect the macro-regulation system to promote the rapid and healthy development of the trust industry.
