试论侦查笔录类证据规范化

2012年《刑事诉讼法》在证据种类中增加了“辨认、侦查实验等笔录”，确立了辨认、侦查实验、搜查、查封、扣押、提取等侦查笔录的法定证据地位。这是证据制度变革中的重大进步与发展，它一方面完善和丰富了法定证据种类，为司法机关证明案件事实提供了更多的有效途径，另一方面对侦查机关依法实施侦查行为和规范制作侦查笔录提出了更高的要求。因此，需要在对侦查笔录的特征及证明功能分析基础之上，反思侦查笔录的现状，结合与侦查笔录类证据有关的程序性机制的研究，对如何规范侦查笔录作进一步探讨。

Humble Comment on the Standardization of Investigative Records Concerning Evidence

Identification, forensic experiment records and so on have been added into the evidence categories in Criminal Procedure Law enacted in 2012, thus establishing the legal evidence status concerning identification, forensic experiment, search, seal, holding, evidence lifting records. This is a great advancement and development of evidence system reformation. On the one hand, it has perfected and enriched the legal evidence categories and provided a new effective channel for judicial agencies to confirm case facts. On the other hand, it has made new requirements for investigative agencies to conduct investigation and standardize their record making. As such, based on the characteristics and functions of investigative records, it is necessary to reflect on the current state of investigative record making, research into the record-making procedure mechanism and probe into its standardization.
