非刑罚处罚措施的司法适用探索

伴随着当前"轻刑化"、"非刑罚"趋势的发展以及刑法的谦抑性要求,非刑罚处罚措施在弥补传统刑罚处罚的空白领域发挥着积极作用,成为对犯罪分子改造教育和承担刑事责任的另一种重要方式。鉴于当前我国刑法规定中非刑罚处罚措施存在的缺陷及问题,在当前司法改革的背景下,目前的非刑罚处罚体系性建设应当在实体与程序上得到进一步的完善,进而使非刑罚处罚措施的体系更加清晰、合理与具有可操作性,推动并促进非刑罚处罚措施在社会司法实践中的适用。

To Explore the Judicial Application of Non-criminal Punishing Measures

Currently , with the trends of ＂light punishment＂,＂non-criminal penalty＂ and the requirements of criminal law modesty , non-criminal punishing measures play a positive role in supplementing the blank of the tra-ditional criminal penalty , being another important way for the criminals to bear responsibility and receive transfor-mation education .Considering the defects of non -criminal punishing measures in the current Criminal Law , the non-criminal penalty system should be further improved in the entity and the procedure under the background of judicial reform , which would go a long way toward making the system clearer , more reasonable and workable and promoting the application of non -criminal punishing measures in social justice practice .
