论网络诽谤犯罪的刑法规制

涉及"网络言论自由"的案件如今已屡见不鲜,纵观我国现行立法,在有关网络诽谤犯罪的预防与惩治过程中暴露出理论研究滞后、司法实践尺度混乱、司法解释缺失以及监管秩序不完善等漏洞。由于法律的滞后性,互联网犯罪日益猖獗的现象使人束手无策,刑法作为维护社会秩序的最后一道防线,必须及时介入、充分保障网络环境有序发展,维护网络用户的合法权益。

It is not surprised to see there are many cases about ＂freedom of speech on the Internet＂now .How-ever ,there are too many loopholes in prevention and punishment of crime of defamation , such as the theory hystere-sis, the confusion of judicial practice scale , the lack of judicial interpretation , the imperfection of the supervision order , etc.Legal lag can do nothing to help preventing the phenomenon of the increasingly rampant lawlessness on internet .As the last line of social order defense ,criminal law must take timely intervention , supply full protection to the development of network , and safeguard the legitimate rights and interests of users .
