论民间文学的知识产权保护

民间文学因为受传统文化因素的影响而表现出诸多特殊属性,加之其他方面的一些原因,许多国家或地区的版权法并不保护民间文学或者并不对民间文学赋予特别的保护。虽然诸如版权法、商业秘密法、商标法和反不正当竞争法等传统知识产权制度都可以赋予民间文学作品一定程度的保护,但民间文学的自身属性导致传统知识产权制度对民间文学作品的不适应性。例如,建立在个体作者基础上的传统版权制度并不适合保护民间文学作品。传统知识产权制度对民间文学保护的不足呼唤民间文学特殊保护制度的建立。
