试论恶势力犯罪团伙的特点及其治理对策

扫黑除恶是我国当前打击刑事犯罪的重点。但是与黑社会犯罪相比,恶势力犯罪团伙并未引起理论界和实务界的足够重视,对后者的研究相对较少,因而在某种程度上妨碍了对后者的准确、有效打击。恶势力犯罪团伙与黑社会具有相似性,但又与黑社会具有很大差别,在形成和组织结构方面具有自己明显的特点,在实施犯罪方面,也有着突出的活动规律。恶势力犯罪团伙的形成和发展,有着多方面的原因,包括政治、经济、文化、教育等方面。基于这些原因,提出了防治恶势力犯罪团伙的具体策略,以实现社会防卫的目的。

Trial Studies of the Characteristics of Evil-force Criminal Gangs and Countermeasures of Tackling

To crack down on organized criminal groups and evil-force criminal gangs is a key in crime control activities of our country. In contrast with the former, the latter is neglected in theory and practice. Few studies hinder correct and effective control of the latter to a certain degree. Although the latter is similar to the former, it has unique characteristics in formation and organization, and it follows evident laws in conducting criminal activities. There are political, economic, cultural and educational reasons for the formation and development of evil-force criminal gangs. Based on them, we put forward detailed countermeasures to prevent and control such gangs.
