| 摘 要： | 民意虽然对死刑适用可能产生一定影响,但这种影响十分有限,影响死刑适用的主要案外因素是媒体和政治决策层的意志。要注意区分真实的民意和因受误导而产生的民意。应当将民意作为检视死刑适用的法律效果和社会效果的标准之一,认真、慎重地加以对待。

| Abstract: | Despite the fact that public opinion could influence the application of death penalty,yet the influence is limited,with the media and policy makers being the major factors out of judicial cases.This treatise suggests distinguishing the real public opinion from the misleading public opinion and considering the public opinion,which ought to be treated seriously and cautiously,one of the standards evaluating the legal and social effect of the application of death penalty. |
