| 摘 要： | 未成年犯罪人不同于成年犯罪人,本着未成年人保护和预防未成年人犯罪的原则,在未成年犯罪人的刑罚执行方式上也应和成年人相区别。现阶段,未成年人社区矫正法律制度与其他法律制度相比,在未成年人法律体系中处于弱势,而该种状况不适应未成年人保护,预防未成年人犯罪,社区矫正应有功能的需要。在未成年人法律制度建设中,应该根据现有法律的调整和未成年人健康成长的需求,逐步完善未成年人社区矫正的立法。
