| 摘 要： | 片面共犯在刑法上并无规定。其与实行犯组成的犯罪形式由于不符合共同犯罪条件,可定名为片面共同犯罪。对片面共同犯罪中的实行犯应按刑法一般原则定罪处罚,而对片面共同犯罪中的片面共犯应根据实行犯的社会危害程度不同,遵循一定的原理,决定是追究其刑事责任。

| Abstract: | There isn't any regulation about the joint offence one-sided in the Criminal Law. And the criminal form made up with the offender isn't in line with the conditions of the joint offence, so it is called as the joint offence one-sided. The offender among the joint offence one-side should be punished to fit the crime according to the principle of the Criminal Law. The accomplice one-sided among the joint offence one-sided should be decided whether to bear the criminal responsibility by the extent of social harmfulness and some principles. |
