行政程序之行政伦理价值简论

行政程序与行政伦理具有终极意义上的共通性。评价法律程序正当性的主要标准是它使人的尊严获得维护的程度。行政伦理从内在道德机制上保证行政行为的“善”,行政程序则依赖外在的法律强制行政行为“合法律性”。在行政程序中建立起尊重与信任、沟通与参与、监督与责任机制,是行政伦理制度化的保障。

Analysis on Ethic Value of Administrative Procedure

It is applicable to both administrative procedure and administrative ethics in ultimate aim.What degrees the dignity of human personality would be protected is the chief criterion to assess the justness of jural procedure.Administrative ethics guarantees that administration conduct is "goodness" from inside moral mechanism,while administrative procedure depends on outside law to compel that administration conduct is "legitimacy".In present administrative procedure construction,the systemization of administrative ethics is based on the establishment of the mechanism of respect and trust,communication and participation,supervision and responsibility.
