| 摘 要： | 文化、教育权利是公民基本权利.它们在权利属性方面存在着下列特点:文化、教育权利具有同质性;文化、教育权利是一种复合性的权利,既具有自由权的特点,又具有社会权的性质;文化、教育权利作为宪法权利决不仅仅是一种"指导规范",而是可司法性的法律权利.

| Abstract: | Cultural right and educational fight are the fundamental fights of citizens that have features as follow:firstly,the cultural fight and educational fight have the nature of homogeneity;secondly,they are complex rights possessing the trait of liberty fight as well as that of social fight;thirdly,as the constitutional fights,Cultural fight and educational right are not only instruction norms,but also justiciable legal rights. |
