159例家庭暴力损伤的法医学鉴定分析

目的　探讨家庭暴力损伤的特点及其有关的法医学鉴定问题。方法　对 1 998年 4月～ 1 999年 1 2月间来诊的 1 59例家庭暴力损伤鉴定案件进行回顾研究。结果　家庭暴力的受害者绝大多数为妇女(占 93 1 % ) ,主要发生在配偶间 ( 85 5% ) ,其次为虐老 ( 7 5% )和虐儿 ( 5% )。家庭暴力一般发生在家中 ,以晚上为发生高峰。致伤方式以拳脚为主 ,其次为随手可得的钝器或锐器。损伤多为软组织损伤 ;有4 0 %的受害人投诉前未去医院就诊 ;损伤程度多为轻微伤 ,达轻伤标准占 1 0 %。结论　家庭暴力损伤具有隐藏性和复杂性 ,准确及时地进行法医学鉴定可为受害人主张权利提供有力的证据和帮助 ,对揭露家庭犯罪有着重要意义

159 Cases of Domestic Violence in Forensic Examination

Objective To explore the characteristic of domestic violence and examination of forensic medicine Methods 159 cases of domestic violence collected from 1998 4-1999 12 were respectively study.Results Most of victims of domestic voence was women(93 1%)which occurred mainly in spouses(85 5%);in addition some victims were elders(7 5%)and children(5%) The violence event was often seen at home in evening The injuries were mainly caused by bare-hands,secondly by blunt or sharp at hand Soft tissue contusion was common about 40% victims haven't to see doctor before report The injury degree of domestic violence in victims were usually slight,about 10% victims were minor injunries Conclusion Tese results indicate that the domestic violence have characteristic of complicate and conceal,accurate forensic examination in time couldprovide a professional evidence for victim in order to keep victim rights and expose domestic criminal provide a professional evidence for victim in order to keep victim rights and expose domestic criminal
