| 摘 要： | 近年来高校校规频频遭遇学生反对,学生对学校处罚不服而向法院提起诉讼的事情时有发生,新的《普通高校学生管理规定》出台后,在一定程度上改善了这一状况,但制度的不完善却使高校的管理工作处于“两难”境地。针对高校学生管理陷入“两难”的原因,要从立法上加明确高校对学生的管理权限及高校与学生方面的法律关系等。

| Abstract: | Recently college students are against the rules of colleges.Some students prosecute colleges.New rules of the state has improved the situation.On the other hand,the system is not perfect and the management of college student are in "two difficulties".Therefore,we should perfect the law and illustrates clearly the management power and the legal relation between colleges and students. |
