Some Reflections on the Latest Practices of Evolutive Interpretation of Treaties

It appears that evolutive interpretation has become a new trend in treaty interpretation today.However,problems exist in the application of interpretative technique such as arbitrariness,rigidity and one-sidedness,which result mainly from the failure to conform to fundamental doctrines of treaty interpretation.In view of the close relationship between evolutive interpretation and contemporaneous interpretation,it is necessary,on the basis of considering all interpretative elements,to make a choice after weighing these two techniques.Building on using existing conceptions,the application of evolutive interpretation shall not violate a treaty’s purpose and aim and may follow certain steps.
