论信访立案制度的法律规制

信访权利救济机制是一种特殊的、补充性权利救济机制,其受案范围不仅包括不能通过诉讼、仲裁、行政复议等法定途径解决的纠纷,也应包括重大、紧急事项以及诉讼等方式不能实质性解决的纠纷。对信访立案制度进行法律规制,一方面要加强信访信息化建设,有效提高信访信息交流效率,为信访立案法律规制提供物质基础和技术保障;另一方面则要强化信访立案和受理的程序规则,避免案件受理的随意性,保障信访人的信访权,降低越级访、闹访、缠访等"非法访"。
