| 摘 要： | 刑事诉讼价值平衡是建立在主体性哲学基础上的平衡，程序正义为诉讼价值平衡的程序法基础。刑事诉讼价值体系是一个多元、开放的价值体系，建构价值平衡的途径主要应当体现内在价值和工具价值之间的平衡、秩序价值和正义价值之间的平衡及效率价值和公正价值之间的平衡。

| Abstract: | Criminal value balance is based on the subject philosophy.Procedural justice is the procedural basis of the value balance.Criminal value system is a pluralistic and open system,and construction approach of the value balance should primarily reflect the balance between intrinsic value and instrumental value,the balance between order value and justice value,the balance between efficiency value and fair value. |
