《政府信息公开条例》的价值缺陷

政府信息公开的最核心的价值追求是强化民主政治,保证民众获得政府信息、防止行政腐败和实现信息对于实际生活的效用只能归之于政府信息公开的附属价值。我国的《政府信息公开条例》回避了对这一核心价值的规定,这种回避不但体现在条例对价值目标的明文规定上,也体现在整个条例的实质性规定中。由于条例对于应公开的政府信息的范围和有权申请获得政府信息的申请人资格的严格限制,以及关于政府信息公开的虚弱的司法救济机制,加之宏观的民主政治建设的滞后,我国政府信息公开的前景不容乐观。

Value Deficiency of Government Information Publicity Regulations

While ensuring the public government information, preventing administrative corruption and realizing the practical effect of information are affiliated values of government information publicity, the strengthening of democratic politics is the core. However, China’s Government Information Publicity Regulations avoids regulations of this key issue, not only in form but also in essence. Therefore, the strict restrictions on the publicity scope and application qualification, the weak judicial remedy mechanism and the delay of macroscopic democratic politics construction lead to a non-optimistic prospect of government information publicity in China.
