共犯中止的司法认定管见

共犯中止的司法认定是一个实践中的难题。对于全体行为主体成立共犯中止,可从时间、主观意志和行为效果三方面要件出发进行综合判断。对于部分行为主体成立共犯中止,目前国内学界主要存在着八种不同观点,其中原因力论更具备合理性。利用原因力论,就部分行为主体成立共犯中止区分简单共犯、复杂共犯,对其中的实行犯、组织犯、帮助犯和教唆犯进行了逐一认定,并且对此刻其他共犯的形态应视不同类别而言。

On Judicial Confirmation of Complicity’s Discontinuance

The judicial confirmation of complicity’s discontinuance is a puzzle in practice.As for the whole complicity’s discontinuance,we can judge by three aspects elements,including time,intention and effect.As for the partly complicity’s discontinuance,there mainly exist eight different theories at home currently,we think the theory of causal function more reasonable by analyzing these theories.Using the theory of causal function,we discern the simple offence and complex offence in partly complicity’s discontinuance,including perpetrators,organizers,assisters and abettors,and judge the other complicity’s forms on the basis of discerning its categories.
