关于消费领域中侵权问题的思考

摘    要:消费领域存在的假冒伪劣产品、虚假广告、商业欺诈等不和谐因素,给消费者的合法权益带来了极大的损害。其根本原因是销售者面临着由功利主义过盛引发的道德危机、诚信缺失问题以及社会责任迷失等问题。为减少侵权行为的发生,必须有一个和谐的消费环境,缓解消费者的信息不对称现象。要充分发挥消费者协会的社会监督作用,细化消费法规与政策,维护消费者权益。

Abstract:Such problems as counterfeit or low-quality goods, false advertisements and commercial frauds in the field of consumption do harm to the legal rights and interests of consumers. These phenomena result from the fact that sellers face risks initiated by utilitarianism and shortage of credibility, and are at a loss to take their social responsibilities. The solution to the above-mentioned problems is to create a harmonious consumption environment, ease the asymmetrical state of information for consumers, play the supervisory part of the association of consumers to the full and make the laws and regulations related to consumption detailed so as to earnestly protect the legal rights and interests of consumers
