| Abstract: | By some cases of conference gene patent and relative dispute in U.S.A, the role of the Patent Law in safeguarding the human ethics and promoting gene research were analyzed in this article. Some legislative suggestions on gene patent was put forward combination with current legislative tendency and judicial practice in the world. |
