刑法机能的时代命题

刑法的机能是刑法价值论领域中不断发展和演变的一个动态性和开放性的理论范畴 ,在现阶段探讨刑法的机能 ,应把握这样几点 :作为刑法维护统治阶级利益的统治工具这个本质机能 ,在当今时代已经历史性演进为全体人民维系自身赖以生存的社会共同生活秩序的需要 ;在本质机能之下分布的若干具体机能中 ,保护人民的机能被空前突出出来 ,成为具体机能体系中的核心机能和最终的价值目标 ;同时刑法具体机能中的另一个基点性机能———惩罚犯罪 ,即具体机能中的其他机能均以惩罚犯罪为必然手段 ,以保护人民为终极目标 ,使得刑法的若干机能呈动态系统性排列。

An Up-to-date Consideration on the Function of Cr iminal Law

Along with the birth and development of criminal law, t he function of criminal law is always in evolution and consideration on this is always necessary in any epoch. At the time being, the following points should be hold when discussing the function of criminal law:the evolution from a tool of class\|ruling to maintain the societal order which is a benefit to every one in the society; in the context of concrete functions under inner function, it is mu ch stressed on the function of protecting the people which become the core funct ion and ultimate aim of criminal law. Punishing the criminals is another basic f unction of criminal law as a contrast to other branches of law. Therefore, all o ther concrete functions are aimed at protecting the people with the measure of p unishing the criminals and present a dynamic system.
