| 摘 要： | 中国古人提出的“天人合一”,既是一种观念形态,又是一种秩序结构。古代中国在综合运用神、道、礼、法的基础上,建立起一个大的法律控制体系;在“天、地、人”之间,王者通三;政治统治的合法性和法律控制的效能建立在自然、历史和文化的基础上,成功地实现了人与自然和谐发展。礼法结合最初表现为习惯法与国家法的结合,它是中国传统法文化精神的凝聚,对于建构一个人际和谐的社会起着至关重要的作用。中国古代和谐社会的法律控制机制给当代社会提供了有益的启示和借鉴。

| Abstract: | "Heaven-humankind in one"advanced by ancient Chinese,is not only a set of ideologies,but also a systematic structure of society.Based on comprehensive application of superhuman strength,Taoism,Confucianism and legal system,ancient Chinese founded a great control system between "Heaven,earth and man".Ancient Chinese ruler established legal status and raised efficiency of legal control on the base of nature,history and culture,which realized that ancient Chinese lived in harmony with nature.Combibation of Confucianism and legal system is the condensation of the spirits of the traditional Chinese legal culture,which played an important role in building a harmonious society between men.The mechanism of legal control of harmonious society in Ancient China provides the contemporary society with beneficial enlightenment and reference. |
