| 摘 要： | 陷害教唆行为具有严重的社会危害性和人身危险性，应该将其作为一种独立的犯罪纳入刑事法律关系之中来进行调整。陷害教唆行为并不是共同犯罪的一种，它同教唆犯有着本质的差别，与警察圈套也并不是完全一致。我国应该通过立法来对陷害教唆行为进行规制和处理。

| Abstract: | The attempted instigation is of great social harmful consequences and personal danger,which should be put as an independent crime into the criminal legal relations for adjustment.It is not a joint crime and differs from instigator in nature.The attempted instigation is also not the same as police trap.We should regulate and deal with it through legislation. |
