| 摘 要： | 基因权的法律性质是基因权研究的基本课题.基因权是民事权利,但基因技术的发展为基因权升格为宪法权创造了条件.基因权作为宪法权利更有利于基因权保护,但在实践中基因权上升为基本权利尚需一定条件的达成.

| Abstract: | The legal nature of genetic right is the basic subject of the research of genetic right.The genetic right is civil right firstly,however,the development of genetic technology makes it possible to promote the genetic right into the fundamental right.Taking genetic right as fundamental right can be more convenient for its protection,but in practice some conditions still need to be achieved before the genetic right truly transformed into the fundamental right. |
