| 摘 要： | 财物遗失后,遗失人与拾得人之间的权利义务关系以及遗失物所有权归属问题是物权法的一个重要课题.我国现行立法对遗失人的权利给予了充分的关注,却忽视了对拾得人权利的保护,使拾得人与遗失人之间的权利义务关系处于失衡的状态.建议立法赋予拾得人报酬请求权和附条件取得遗失物所有权的权利,以完善拾得人权利体系的构建.
