“亲亲相隐”对我国现行刑事立法的启示

“亲亲相隐”的嬗变是从人类为了解决伦理(人情)与法(国法)之间的矛盾开始的。随着历史的演进,“亲亲相隐”从维护统治阶级统治的工具变嬗变为了体现人性的一项制度设计。“亲亲相隐”最大的价值就在于倡导和维系了人与人之间诚信友爱的和谐关系。因此,在我国构建和谐社会的语境中,我国现行刑事立法应当通过合理的设计实践“亲亲相隐”的积极价值。这将有利于推动我国构建和谐社会的进程。
