破产管理人选任制度研究

我国新破产法首次引入了管理人制度，管理人是破产程序中最为重要的机构之一，居于相当重要的地位。而破产管理人的选任是破产管理人制度的重要环节，管理人的选任关系到债权人、债务人等各方利益。根据我国新破产法及司法解释关于管理人选任的相关规定，文章从破产管理人的选任主体、方式、资格、选任时间、更换等方面，分析了我国现阶段破产管理人选任制度理论和实践操作中存在的一些不足，并提出了完善该制度的措施。

A Study on the Election of Insolvency Representatives

China＇s new Bankruptcy Law implanted for the first time the institution of insolvency representatives, which is of essential necessity. Insolvency representative is a most important organ in the course of bankruptcy, the election of which has a direct impact on the rights and interests of both the creditors and the debtors. This essay, in accordance with the UNCITRAL Legislative Guide on Insolvency Law, China＇s Bankruptcy Law and related judicial interpretations, analyzes the drawbacks of the election of insolvency representatives in respective of their standing, qualification, challenges, terms and substitution, and puts forwards the measures to further improve the institution.
