| 摘 要： | 海洋生态损害悄然蔓延,通过民事赔偿行政处罚已无法补救,如不采取凌厉的刑罚手段予以遏制,势必危及人类生存。《联合国海洋公约》亦为之设立专门条款,而我国刑法在海洋生态保护方面凸显薄弱。建议增设保护海洋生态的特别刑法条款,且将海洋生态损害犯罪界定为危险犯。

| Abstract: | Impairing ocean ecological balance spreads quietly.It is necessary to protect ocean environment by criminal law for all mankind.So,does the United States,Germany or the United Nations Convention on the Law of the Sea,but the Criminal Law of China. Hence,we suggest making special criminal provision for protecting ocean ecological balance. |
