| 摘 要： | 中国的法律现代化从1902年清政府下诏修律以来,已走过一百年的历程。从修律之始,传统与现代的矛盾就十分突出。尽管由于政治上的原因,法律条文已经现代化了,但它“和社会不适合,和历史不联接”。这个矛盾至今没有解决,在很多领域表现还十分突出。它仍是当代法理学和法史学的主要问题。

| Abstract: | It' s about a century since China commenced the legal modernization in Qing Dynasty in 1902. From the beginning, there had been a great gap between Chinese tradition and modern western legal system. We have modern code, but it doesn" t meet our society and history well. Being unsolved in many fields, it' s still one of the key problems in modern jurisprudence and historical science of law. |
