| 摘 要： | 违法阻却和责任阻却抗辩事由的证明责任由控方还是被告方承担,可以从刑事推定的适用、犯罪构成理论、诉讼模式的差异以及价值权衡等诸多角度进行分析。通过对这些因素的考量,得出我国刑事抗辩事由的客观证明责任由控方承担的结论。

| Abstract: | In accordance with the principle of presumption of innocence,the burden of Proof of the guilt of the accused is distributed to the prosecution.However,for convenience,policyand other reasons,certain elements of crime may be distributed to the accused.Which side responsible the burden of proof of criminal defend,should consider the application of the criminal presumption,constitute of crime,the value and so on.Through consideration these factors,the prosecution should been distributed the objective burden of proof of our criminal defend. |
