| 摘 要： | 辩诉交易是盛行于美国的一项刑事诉讼制度,我国也在刑事诉讼中开始了这一制度的实践.然而,就我国目前状况而言,辩诉交易并不是解决公正与效率之间冲突的最佳途径,我国还不具备引进该制度的条件和机制.
