中国大陆与台湾地区刑事再审程序之比较研究

近年来 ,刑事再审程序的改革已越来越受到诉讼理论界和司法实务界的关注。借鉴其他国家和地区的诉讼制度势必会促进我国诉讼制度的完善。我国台湾地区的刑事诉讼法主要借鉴了德、日诉讼制度 ,同时也吸收了美国诉讼制度的内容。为此 ,在探讨我国刑事再审制度改革的今天 ,借鉴台湾地区的刑事再审制度 ,有着十分重要的意义。

Comparative Study of the Criminal Supervision Proceedings of China and Taiwan Province

In recent years,theorists of lawsuit and judicial departments have paid more and more attention to the reform of the criminal supervision proceedings.Drawing lessons from lawsuit system of other countries and districts can promote completeness of our country's lawsuit system.Criminal suit law of Taiwan province mainly has drawn lessons from the lawsuit system of Germany and Japan,meanwhile,has absorbed the lawsuit system of the U.S.So it is very important that drawing lessons from the criminal supervision proceedings of Taiwan province in the course of investigating our's.
